1. Agreement to Terms

By accessing or using the services provided by KalpOps ("we," "us," or "our"), including our website, training programs, and related services, you ("you" or "Student") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Training Programs & Services

2.1 Program Description

KalpOps provides DevSecOps training programs delivered through live online sessions, hands-on labs, and supplementary materials. Course content, duration, and curriculum are subject to change at our discretion to ensure quality and relevance.

2.2 Free Demo / First Lecture

We offer a free first lecture/demo session for prospective students to evaluate our training methodology before enrollment. This demo is provided without obligation to purchase.

2.3 Batch Requirements

Training batches require a minimum of 5 participants to commence. If the minimum batch size is not met within a reasonable timeframe, students will be offered the choice of:

  • Joining the next available batch
  • Full refund of the enrollment fee

2.4 Schedule & Attendance

Training schedules will be communicated prior to batch commencement. While we strive to maintain schedules, we reserve the right to reschedule sessions with reasonable notice due to instructor unavailability or technical issues.

3. Payment Terms

3.1 Pricing

All prices are displayed inclusive of applicable taxes. Payment must be completed before accessing paid training content.

3.2 Payment Methods

We accept payments via Razorpay, supporting UPI, debit/credit cards, netbanking, and wallets. All payments are processed securely through this third-party provider.

3.3 Invoices

Upon successful payment, an invoice will be generated using the billing address provided during checkout.

4. Refund Policy

4.1 7-Day Refund Window

Full refunds are available within 7 calendar days from the date of enrollment, provided:

  • The training batch has not yet commenced, OR
  • No more than 2 training sessions have been attended

4.2 No Refunds After 7 Days

No refunds will be issued after 7 calendar days from enrollment, regardless of attendance or completion status. By enrolling, you acknowledge and accept this policy.

4.3 Refund Process

To request a refund within the eligible period, contact us at anshul@kalpops.com with your enrollment details. Refunds will be processed within 7-10 business days to the original payment method.

4.4 Batch Cancellation by KalpOps

If KalpOps cancels a batch (e.g., minimum participants not met), enrolled students will receive a full refund regardless of the 7-day window.

5. Intellectual Property

5.1 Course Materials

All training materials, including slides, code samples, lab guides, recordings, and documentation, are the intellectual property of KalpOps. Students receive a personal, non-transferable license to use these materials for personal learning purposes only.

5.2 Restrictions

Students may NOT:

  • Reproduce, distribute, or share course materials publicly
  • Record training sessions without explicit permission
  • Use materials for commercial purposes or competing training services
  • Sub-license or transfer access to third parties

6. User Conduct

Students agree to:

  • Provide accurate registration information
  • Maintain confidentiality of login credentials
  • Behave professionally during training sessions
  • Not engage in harassment, discrimination, or disruptive behavior
  • Not attempt to reverse-engineer or exploit technical systems

We reserve the right to terminate access for violations without refund.

7. Limitation of Liability

7.1 No Guarantees

KalpOps does not guarantee specific outcomes, including but not limited to:

  • Job placement or employment
  • Salary increases or promotions
  • Certification exam passage
  • Specific skill proficiency levels

Training effectiveness depends on individual effort, prior knowledge, and consistent participation.

7.2 Maximum Liability

In no event shall KalpOps, its instructors, affiliates, or employees be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or other intangible losses, even if advised of the possibility of such damages.

Our total liability for any claim arising from or related to our services shall not exceed the amount paid by you for the specific training program in question.

7.3 Third-Party Tools & Services

Training may involve third-party tools (AWS, Docker, etc.). Students are responsible for adhering to terms of such third-party services. KalpOps is not liable for issues arising from third-party platforms.

7.4 Technical Issues

While we strive for uninterrupted service, we are not liable for technical disruptions, internet connectivity issues, or platform outages beyond our control.

8. Disclaimer of Warranties

Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Indemnification

You agree to indemnify, defend, and hold harmless KalpOps, its instructors, officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any third-party rights

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the modified Terms.

11. Governing Law & Disputes

These Terms shall be governed by the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Delhi, India.

Before pursuing legal remedies, parties agree to attempt good-faith resolution through direct communication.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
